who I am
leovferguson.com is run by me, Leo V. Ferguson III, as an individual in Florida. “I” and “me” mean me; “you” means you. By making an account or buying anything here, you agree to these terms and to the privacy policy.
who can use the site
You must be 18 or older to make an account. By making one, you confirm you are.
your account
One account per person. You're responsible for what happens on your account. Your username is public; your email never is. I may suspend or delete an account that breaks these terms.
membership
Membership is $6 a month. It renews automatically every month and charges the card you paid with until you cancel. You can cancel anytime from your account page; your membership stays active until the end of the month you've paid for. No refunds, except when required by law. If the price ever changes, I'll email you at least 7 days before it takes effect, with how to cancel.
badges
Members get one member badge, numbered by when they joined. A badge is a mark, nothing more: it can't be sold, transferred, or exchanged for money. You keep it if your membership ends. If an account is deleted or removed for breaking these terms, its badge is retired for good and never reissued.
the chat wall
A message is $3, up to 50 characters. When you pay, your card is held, not charged. I review every message within 24 hours. If I approve it, your card is charged and the message stays where you placed it. If I don't approve it, or it isn't reviewed within 24 hours, the hold is released and you aren't charged. Messages that are hateful, threatening, or offensive are denied. You can post anonymously. I may remove any message at any time; a removed message isn't refunded.
q&a
A question is $5, up to 280 characters. When you ask, your card is held, not charged. It's charged only when I answer. If I decline your question, or don't answer within 24 hours, the hold is released and you aren't charged. You can have one question waiting at a time, and a question can't be edited after you send it. Answered questions and their answers are posted publicly on the q&a; you can ask anonymously. An answer is delivered when it's posted. My answers are my personal opinions, not legal, financial, or business advice; don't rely on them as such. I may remove an answered question at any time; a removed question isn't refunded. No refunds, except when required by law.
games
How I sell a game is up to me: by the chapter, as a whole game, in a bundle, or another way. Each purchase shows what you're buying. What you buy is a license to play it in your browser while signed in, with an internet connection; nothing is downloaded. Games you buy stay playable for as long as this site is running. If I ever have to stop offering one, or close the site, I'll email you at least 30 days before. No refunds, except when required by law.
what you post
You keep the rights to your words. By posting a message or question, you let me show it on the site, permanently, including after your account is deleted, when it shows as anonymous.
what I make
The journal, the games, and everything else I publish here are mine. They're for your personal use; don't copy, share, or resell them. Members-only entries stay members-only.
don't
Post anything hateful, threatening, harassing, or illegal; share other people's private information; pretend to be someone else; use bots or scrapers; or get around the site's security or payments.
deleting your account
You can delete your account from your account page. It's deleted 7 days later; until then, you can sign in and cancel. Deleting stops your membership from renewing and releases any held payments. After 7 days your account, username, and membership are gone. Placed wall messages and answered questions stay, shown as anonymous. A record of the terms you agreed to when buying is kept, with no name or email attached. Your badge is retired for good.
no guarantees
The site is provided as it is. I work to keep it running, but I can't promise it will always be available or free of errors.
limits on liability
To the extent the law allows, I'm not liable for indirect or incidental losses, and my total liability to you is limited to what you paid me in the 12 months before the claim.
disputes
If something goes wrong, email me at hello@leovferguson.com first, and give me 30 days to make it right. If we can't, these terms are governed by Florida law, and disputes go to the state or federal courts in Florida. Either of us may use small claims court instead.
changes
I may update these terms. The date at the top shows the latest version. If a change affects your membership, I'll email you first.
